Discrimination Against Domestic Workers

Problem Statement:

The First Schedule in the Employment Act 1955 explicitly discriminates against domestic workers, excluding these sector of workers from basic rights afforded to all other workers in the Act. The Act also refers to Domestic Workers are "servants" in the Act. The EA 1955 is the reference for the definition of what a worker is for other worker related legislation like the EPF Act 1991, SOCSO Act 1969 and Minimum Wage Order which all, follow the discriminative reading in the EA and exclude domestic workers from enjoying these social protection rights.

All workers should have access to equal rights protection and benefits.

Proposal of Solution:

Amend the discriminative clauses in the First Schedule of the EA1955 and amend the reference of Domestic Workers in the EA1955 as "domestic servants" to "Domestic Workers".
